1. Agreement to Terms
By accessing or using Widgitboard ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.
Widgitboard is a digital signage platform. These Terms apply to all users of the Service, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.
2. Use License
Widgitboard grants you a non-exclusive, non-transferable, revocable license to use the Service for personal or commercial digital signage purposes, subject to these Terms.
You may:
- Use the Service to create and display digital signage content
- Access the Service from multiple devices
- Use the Service for commercial purposes
You may not:
- Attempt to decompile, reverse engineer, or hack the Service
- Use the Service to distribute malware, spam, or illegal content
- Interfere with or disrupt the Service or servers
- Impersonate others or provide false information
- Use the Service for any unlawful purpose
Acceptable Use Policy
You agree not to use the Service in any way that:
- Overwhelms, degrades, or disrupts our infrastructure through automated scraping, excessive API calls, or denial-of-service activity
- Resells, sublicenses, or commercially redistributes access to the Service or its features to third parties
- Displays content that is defamatory, obscene, hateful, discriminatory, or that promotes violence
- Violates any applicable law, regulation, or third-party rights, including intellectual property and privacy rights
- Circumvents, disables, or interferes with subscription verification, watermarks, or other access-control mechanisms
- Creates multiple accounts to abuse trial periods, promotional offers, or usage limits
Violation of this policy may result in immediate suspension or termination of your account without refund. We reserve the right to determine, at our sole discretion, whether use of the Service violates this policy.
3. User Accounts
When you create an account with us, you must provide accurate and complete information. You are responsible for safeguarding the password and for all activities that occur under your account.
You agree to notify us immediately of any unauthorized use of your account. We reserve the right to terminate accounts that violate these Terms.
4. User Content
You retain ownership of any content you create or upload to the Service ("User Content"). By uploading User Content, you grant Widgitboard a non-exclusive license to store and display your content as necessary to provide the Service.
Content Guidelines:
- You must have the right to use any content you upload
- Content must not violate any laws or third-party rights
- Content must not be obscene, defamatory, or harmful
- You are solely responsible for your User Content
5. Third-Party Services and APIs
The Service relies on and integrates with third-party services and APIs including but not limited to:
- Google Authentication (for sign-in)
- Firebase (for data storage and sync)
- Weather APIs (OpenWeatherMap, Open-Meteo, etc.)
- News and RSS feed services
- YouTube and video embedding services
- Financial data APIs (stocks, cryptocurrency)
- Transit and transportation APIs
- Space launch and astronomy APIs
- Health and environmental APIs (UV index, pollen, air quality)
- Entertainment APIs (movies, music, recipes, cocktails)
- Wikipedia and knowledge APIs
- Event and calendar APIs
Your use of these third-party services is subject to their respective terms and privacy policies. Widgitboard is not responsible for the content or practices of third-party services.
API Availability Disclaimer
IMPORTANT: Many widgets and features in Widgitboard depend on third-party APIs and external data services. These third-party services may:
- Change their terms, pricing, or availability at any time without notice
- Be temporarily or permanently discontinued by their providers
- Experience outages, rate limiting, or service interruptions
- Modify their data formats, endpoints, or functionality
- Restrict access based on geographic location or usage patterns
Widgitboard makes no guarantees regarding the continued availability, accuracy, or reliability of any third-party API or data source. If a third-party service becomes unavailable or is discontinued, the affected widgets may cease to function properly. We will make reasonable efforts to find alternative data sources or update affected widgets, but we cannot guarantee uninterrupted service for features that depend on external APIs.
You acknowledge and agree that Widgitboard shall not be held liable for any damages, losses, or inconvenience resulting from the unavailability, modification, or discontinuation of any third-party API or service upon which our widgets depend.
6. Intellectual Property
The Service and its original content (excluding User Content), features, and functionality are owned by Widgitboard and are protected by international copyright, trademark, and other intellectual property laws.
All rights in the Service not expressly granted herein are reserved by Widgitboard. Nothing in these Terms grants you any right to the Widgitboard name, logo, trademarks, or proprietary technology.
7. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Widgitboard does not warrant that the Service will be uninterrupted, secure, or error-free. We do not guarantee the accuracy or completeness of any content displayed through the Service.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WIDGITBOARD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
In no event shall our total liability exceed the amount you paid us in the twelve (12) months preceding the claim.
9. Subscription and Billing
9.1 Pricing
Widgitboard is a paid subscription service. Current pricing is available on our Pricing page. We reserve the right to change pricing with 30 days' advance notice to existing subscribers.
9.2 Subscription Access
Access to the editor and display features requires an active paid subscription. Your layouts are preserved if your subscription lapses, but access to premium features will be restricted until you resubscribe.
9.3 Billing
Subscriptions are billed in advance on a monthly or annual basis through our payment processor, Stripe. By subscribing, you authorize Stripe to charge your payment method on a recurring basis. All amounts are in US dollars unless otherwise stated.
9.4 Cancellation
You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period. You will retain full access until then. No partial refunds are given for unused time within a billing period.
9.5 Refunds
If you are not satisfied within the first 30 days of your paid subscription, contact us at support@widgitboard.com for a full refund. After 30 days, refunds are issued at our sole discretion.
10. Indemnification
You agree to indemnify and hold harmless Widgitboard and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service or violation of these Terms.
11. Termination
We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms.
Upon termination, your right to use the Service will immediately cease. Your layouts and account data will be retained for 30 days after termination to allow reactivation. After 30 days, your data will be permanently deleted. You may request immediate deletion of your data at any time in accordance with our Privacy Policy.
12. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. For users in the European Union, nothing in these Terms affects your rights under applicable EU consumer protection laws.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on this page and updating the "Last updated" date.
Your continued use of the Service after any changes constitutes acceptance of the new Terms. We encourage you to review these Terms periodically.
